Voucher Purchase

1. All purchases of a voucher for a hot air balloon flight experience must be made on our standard booking form.

2. Vouchers may be ordered by telephone or online but you must send us a completed booking form as soon as possible.

3. This contract is made with you but you can give it to someone else provided you tell us in writing. These Terms and Conditions will still apply and "you" in the rest of the Terms and Conditions will refer to that person.

4. It is our intention that all the terms of the contract between us are contained in these terms and conditions and in any brochures and associated documents (if any) issued by us. If you wish to rely upon any variation in these terms you should ensure that the variations are agreed in writing by us at the time of purchase. If you do not wish to be bound by them, please return your flight vouchers within 14 days of the date of purchase for a full refund (less a £10 charge per transaction to cover credit card, banking and administration costs). After this period, the costs incurred in operating and setting-up flights are such that a refund will not be granted, except under the circumstances described in paragraph 10. The flight voucher is not redeemable for cash.

Our obligation to you

5. All flight vouchers are issued on the basis that they are for any day in the category chosen, and not for a specific day, even when a flight date has been booked at the time of purchase. Flight vouchers may be upgraded to a different category for the price difference at the time of the upgrade.

6. The voucher will entitle you to participate in a hot air balloon flight experience at a date, to be arranged, within the 12 months validity of the voucher including:

* The preparation and inflation of the balloon for flight

* A flight in a hot air balloon

* The recovery of the balloon at the end of the flight and transfers back to the launch site

* Champagne, flight certificate

7. Hot air balloons flights are completely dependent upon the weather and are regulated by the Air Navigation Order. It may be necessary to postpone a flight at any time if in our judgement the conditions are not safe or the flight would not be permitted under the Air Navigation Order. We will give you as much warning as operational procedures allows of any postponement but in order to ensure your safety we reserve the right to postpone a flight at any time up to the moment of launch. Neither we nor our sponsor accept liability for any cost or expense you incur if we have to postpone any flight, where the reason for postponement is beyond our control. Cancellations on the launch site are rare but occasionally they are necessary when the Meteorological Office does get the forecast wrong!

8. It is intended that the balloon will be in the air for approximately 45 – 60 minutes but the pilot has the ultimate responsibility for deciding the duration and conduct of any flight and the appropriate time and place of any landing. We cannot guarantee that a flight will follow any particular direction and the launch site will be chosen by the pilot to ensure the flight is conducted safely and within the terms of the Air Navigation Order.

9. If we have to postpone your flight on eight or more occasions and your voucher is then valid for a period of less than two months we will extend the validity period of your voucher to include the next six months of the flying season (April to October inclusive). Otherwise the expiry date of the voucher may be extended for a further 6 months period at a cost of £35 per person. If you need to extend your vouchers after 2 months past the expiry date extra charges may apply.

10. We will make you a refund less our administration costs in the following circumstances only (our administration costs are 25% of the booking fee.):

* if you die or it is certified by a doctor that there is no possibility that you were, are or will be medically fit to fly (other than by reason of pregnancy) during the validity period of the voucher.

* if we have agreed in writing at the time of the voucher purchase that the flight must be taken on a specified date or within a specified period of time of not more than one month and we are unable to fly at that time

11. If you are unable to fly during the validity period of your voucher because you are pregnant we will extend the validity period by nine months.

12. To accommodate unforeseen changes in the personal circumstances of the passenger, flight vouchers are fully transferable allowing the nomination of alternative passengers.

13. We carry insurance cover against the risk of any injury to passengers and during the course of our flights in accordance with international agreements covering air transport. The level of cover varies from time to time as a result of currency fluctuations. Further details are available upon request. We will not be liable for any loss or damage to equipment and effects brought with you on the flight nor for death or personal injury above the level of our insurance cover.

14. We are unable to guarantee the in-flight photograph being taken on all of our flights. Once the in-flight photograph/CD-Rom has been ordered we are unable to refund these under any circumstances.

Your obligation to us

15. Your voucher is valid for 12 months. If your flight is not taken within that time you lose the right to participate in a flight unless you have booked flights on eight or more occasions which have had to be postponed or the validity period of the voucher has been extended for some other reason under the terms and conditions.

16. Our flying season runs from April to October inclusive, therefore we recommend that you book your flight as soon as possible to allow for unsuitable weather conditions, thus making it possible to rebook your flight within this 7 month period.

17. You must contact us within the first 3 months of the validity of the voucher, quoting the booking number on the voucher to make a first booking for your flight which must be for a date within the first 9 months of the validity. If you do not do so the voucher will be invalid and you lose the right to your flight. We do not make any refund in these circumstances.

18. You must telephone our Flightline to check that the flight has not been affected by adverse weather conditions in accordance with our instructions.

19. You may postpone your flight up to 3 working days before your scheduled flight date, provided that at the time you do so you re-schedule your flight for a mutually convenient date within one month of the postponed flight.

20. If you do not give notice to our booking office by either speaking to one of our representatives or at least by leaving an answer phone message in accordance with paragraph 19 above and do not attend in time to take part in your booked flight, you will not be entitled to a re-scheduled flight nor any refund.

21. We are not qualified to express an opinion confirming that you are fit to fly and you must ensure that you are fit to fly. You must not fly if you are suffering from any serious medical condition, or have recently undergone surgery unless you have a certificate of your fitness to fly from your doctor. You must not fly if you are pregnant or under the influence of alcohol or drugs.

22. Our paramount consideration is your safety and the safety of others participating in the flight and you must obey all requests and instructions issued by any of our representatives and take particular care to abide by any safety instructions given. The pilot has complete discretion as to whether to allow you to take part in the flight and will refuse to allow you to do so if in his opinion you would be a risk to the balloon to other passengers or to yourself.

23. Passengers who have taken advantage of our group discounts must fly as a group and not fly on separate occasions.

24. We do not fly children under the age of 7 years. A child under the age of 16 will only be flown if accompanied by a responsible adult.

25. You should wear such appropriate clothing as is advised to you in advance of the flight and as further detailed in our brochure.
